These Terms and Conditions establish the condition for sales made between any natural person who wishes to make a purchase of SUIFF product’s (“Products”) at https://www.suiff.com/ website/s (“Online Store”) and ESTEL, S.L., a company of Spanish nationality, registered with the number B-08331340, in Barcelona, with registered office at Can Noguera 19, 1-2, 08630 Abrera (Barcelona), Spain (together “SUIFF” or “us”, as required by the context).
1. ABOUT THESE TERMS AND CONDITIONS.
These Terms and Conditions apply only to purchases made in the Online Store. We may occasionally change these Terms and Conditions. We will detail in the heading the date of entry into force. Any changes to the Terms and Conditions will apply to orders placed on or after the effective date.
BY ORDERING PRODUCTS, YOU AGREE TO BE LINKED TO THESE TERMS AND CONDITIONS AND ACCEPT THE SAME.
2. PLACE AN ORDER.
Please, note that orders can only be places by individuals. Therefore, we will not accept orders placed by companies, associations, independent contractors or any other type of legal entity.
To be able to buy Product/s, you will have to:
Provide your name and address, telephone number, e-mail address, payment details and other information required;
Be at least 18 years old.
In the event that You have created an account with a personal user identification and password, keep your password protected at all times and do not disclose it to anyone, as you are personally responsible for each purchase made with your username and password.
3. PROCESSING OF AN ORDER AND CONCLUSION OF THE CONTRACT.
You agree that your order is an offer to purchase the Products listed in your order, in accordance with these Terms and Conditions. We must accept all orders.
After receiving your order, if we accept it, we will send you an order confirmation by e-mail, with your order number and details of the Product/s you have requested and the Terms and Conditions. The conclusion of the contract will take place at the time you receive the order confirmation by e-mail.
You are responsible for the accuracy of the information you provide to us.
The order confirmation e-mail constitutes your proof of purchase. Please, save it.
4. PRICES, TRANSPORT AND HANDLING, CHARGES AND TAXES.
The price charged for a Product will be the price in effect at the time the order is placed and will be reflected in the order confirmation e-mail.
We may change prices at any time without notice. Price increases will not apply to orders placed after these changes.
The prices of the Product/s include VAT, but not including the costs corresponding to transport and handling, or customs, or any other type of tax, unless the e-commerce product page specifies otherwise.
The charges corresponding to transport, handling and the corresponding VAT or other taxes will be displayed in the Online Store during processing of the order and, in any case, in the e-mail confirming your order.
In the event that we determine that expenses cannot be reasonably calculated prior to the conclusion of the contract, we will inform you of the manner in which the total price will be calculated.
We deliver the Product/s only in Spain and the European Union, and in accordance with the following restrictions:
The delivery options are as follows:
Standard: Estimated delivery time of 3 to 5 working days (except Canary Islands, Ceuta, Melilla and Andorra, which may be longer).
Both the delivery time and the delivery option you choose will be confirmed in the order confirmation.
The delivery period will not exceed 30 days from the conclusion of the contract, unless you, specifically, accept a later date. In the event that you do not receive the order within this period, you will have the right to request delivery, granting us a new reasonable delivery time. If this does not happen, you will be able to terminate the contract and you will be entitled to a refund of all amounts you have paid.
We may reject those orders in which you require a certain delivery time, if this implies the impossibility of meeting the required delivery time. In those cases where you have requested delivery within a certain period or days, you will have the right to terminate the contract if we do not meet the specific deadline.
If you place an order for custom Product/s, the manufacturing time for that/these Product/s will be added to the delivery time of the selected supply option.
In the event that you, unreasonably evade delivery or delay receipt of delivery after we have notified you that we have attempted to deliver the requested Product/s to you, or in the event that you have provided us with an incorrect delivery resulting in a failed delivery, the package to be delivered will be returned to us. In the even that, after the first delivery attempt, the Product/s remain undelivered for a period of 7 working days and is/are not returned undelivered, we will have the right to cancel the contract and we will refund the amount in accordance with the provisions of Article 9.
We will not be liable for delay or non-compliance in the event that the delay or non-compliance is due to circumstances beyond our control in accordance with generally accepted law or principles.
Please, examine the delivered package and the Products received within 14 (fourteen) days from the time they were delivered to you, check their condition and that the contents of the delivered package are complete. In case of damage to the Product/s or in case of missing a Product, please, contact us via e-mails, telephone numbers and forms intended for this.
6. AVAILABILITY OF THE PRODUCT/S.
We do not guarantee the availability of any Product in the Online Store.
Unless we accept your order, we reserve the right, without liability or notice, to change, suspend or discontinue the availability of any Product.
7. COMPATIBILITY, PRODUCT INFORMATION.
When placing an order, please, ensure that the Product/s you purchase is/are compatible for the intended use. Please, use the information provided in the Online Store as a final point of reference for you when checking compatibility. In the event of a difference between the content of the Online Store and any other website (or any other source of information), the accounting of the Product/s as shown in the Online Store at the time of purchase, will prevail.
Payments can be made by credit card.
All payments will be subject to security checks.
Therefore, our services may contact you in order to confirm your order information, as well as order details, such as address, address of the person indicated as the recipient of the order, etc.
9. RETURN AND REFUND.
Please, note that we will only process returns and refund for Product/s purchased in the Online Store.
Right of Withdrawal: If you have purchased Product/s for your private use as a consumer and wish to exercise your right to withdraw from the contract and return the Product/s, you may do so by sending an e-mail to email@example.com or by calling 0034 93 825 46 21, within 14 days from the date you received the last Product.
In order to exercise your right of withdrawal and return the Product/s, please, send an e-mail to firstname.lastname@example.org or call 0034 93 825 46 21 indicating the reason for withdrawal, the invoice number, the day received, name and surname, and the e-mail with which you made the purchase and address where it was delivered.
You may only return the Product/s that have been reasonably cared for by you and that have not been used and are sealed in their original packaging. You will be responsible for any decrease in the value of the Product/s derived from a use on your part of the Product/s other than that use that is necessary to determine the nature, characteristics and correct operation of the Product/s you have purchased.
PLEASE, NOTE THAT YOU WILL NOT BE ABLE TO EXERCISE THIS RIGHT OF WITHDRAWAL WITH RESPECT TO ANY PRODUCT, WHICH HAS BEEN MANUFACTURED IN ACCORDANCE WITH THE CONSUMER SPECIFICATIONS OR HAS BEEN CLEARLY PERSONALIZED.
Once we have received your online statement regarding termination of the contract, we will send you a confirmation e-mail.
You must then return the Product/S without undue delay and, in any case, no later than 14 days from the date on which you notified your decision to withdraw from the contract. You will bear the cost of returning the Product/s.
You must return the Product/s in their original package.
You must include all accessories, user manuals, and any gifts included in the package.
If a Product has been purchased as part of a set of multiple Products, all Products that are part of the set must be returned.
Please, treat the Product/S with reasonable care and return it/them in the same condition in which it/they was/were delivered to you.
Please, pack the Product/s securely and ensure that the RMA number (previously provided to you by telephone or e-mail) is clearly visible on the outside of the package.
Process for receiving RMA number:
In order to ensure a fast and safe return, we suggest that you comply with the following return instructions:
- Request an RMA number by contacting our technical support at email@example.com
- Pack the products together with the required documentation requested and the RMA number.
- Write the RMA number on the outside of the box and send the items to be received within 14 days of the RMA being issued to the address provided.
We will refund the price you paid for the Product/s and the initial shipping costs within 2 days from the date we received the returned Product/s in our warehouse.
If you have chosen the Express delivery option, only the initial shipping costs corresponding to the Standard delivery option will be refunded.
Refund will be confirmed by e-mail.
Payment will be made through the same means of payment that you used in the initial transaction.
If you return Product/s 1) that you are not authorized to return, 2) that you have damaged or used differently from that which is necessary to determine the nature, characteristics and operation of the Product/s, 3) that it/they is/are not complete or 4) that it/them has/have not been treated with reasonable care during the time you had them in your possession and/or when you return it/them; we reserve the right, either to refuse its/their return and to decline the reimbursement, or deduction, of those payments that must be reimbursed, the decrease in the value of the Product/s, all in accordance with the applicable law.
Other cases of return: In the event that the Product/s you have received do not correspond to the one/s you have requested, or in the event that your order is incomplete or has been damaged during transport, please, contact us, either via e-mail or phone, for assistance.
10. WARRANTIES AND LEGAL RIGHTS.
We grant you a legal guarantee in accordance with Spanish law.
Our Product/s Warranty Policy is detailed at the end of this document in the “Warranty and Liability Policy” section.
PLEASE, NOTE THAT THIS WARRANTY POLICY DOES NOT AFFECT, EXCLUDE, LIMIT, OR SUSPEND (AND SHOULD NOT BE INTERPRETED IN THIS SENSE) THE RIGHTS YOU HAVE BY LAW.

11. PERSONAL DATA.
We will take reasonable care to keep the information related to your order and payment secure. However (in the event that there is no serious negligence on our part), we will not be liable for any damage and/or injury that you may suffer in the event that third parties make unauthorized access to any of the data that you have provided when you access or place an order from the website.
12. OUR RESPONSIBILITY.
These Terms and Conditions establish all of our obligations and responsibilities in relation to the Product/s. To the fullest extent permitted by applicable law, we make no warranties, whether express or implied, or accept other terms or conditions that bind us, except as expressly set forth in these Terms and Conditions. In particular, we will not be responsible for ensuring that the Product/s are suitable for your purposes, unless you have informed us of such purposes at the time of the conclusion of the contract and we have accepted them.
We will make reasonable efforts to verify the accuracy of any information we include in the Online Store. We do not warrant that the Online Store will meet your requirements or be interrupted or error-prone, or that defects will be corrected, or that the site or server that allows its availability is free of viruses or errors or that they allow total functionality, accuracy and/or reliability of the Online Store. We will not be liable to you for any loss of content or material downloaded or transmitted through the Online Store.
We will not, under any circumstances, be liable for loss of income, lost profits, loss of contracts, businesses or planned savings, loss of data, loss of goodwill, loss of reputation or for any damage and/or injury, whatever their nature or the way in which they originate. However, nothing in this Section shall affect your legal rights and nothing in these Terms and Conditions will exclude or limit liability that may not be legally limited or excluded in accordance with applicable law, including, by way of example and not limitation, liability arising because of death or injury due to negligence or fraud.
The Online Store may only be used for legal purposes and in a manner permitted by law. You agree to comply with all applicable laws regarding the Online Store and any transactions made in or through the Online Store.
If any of the stipulations of these Terms and Conditions becomes invalid, illegal or inapplicable, this stipulation will be applied to the maximum extent permitted by law, and the validity, legality and applicability of the other stipulations will not be considered, affected or impaired.
Anything related to purchases in the Online Store will be communicated electronically by sending an e-mail or by another electronic publication.

15. APPLICABLE LAW
These Terms of Sale are governed by and enforced in accordance with Spanish Law.
WARRANTY AND LIABILITY POLICY.
- Subject to the conditions set forth below, Seller warrants that the Goods will conform to specifications at the time of delivery and will be free from defects.
The Seller grants the aforementioned guarantee subject to the following conditions:
Seller shall have no liability in respect of defects arising as a result of normal wear and tear, intentional damage, negligence, abnormal working conditions, failure to follow Seller’s instructions (either orally or in writing), or alteration or repair of the Goods without the approval of the Seller.
The Seller will have no liability in relation to the aforementioned guarantee if the total price of the Goods has not been paid on the due date.
In the event of any claim duly justified and sustained with respect to any of the Goods based on a defect in the quality or conditions of the Googds or a breach of the specifications, the Seller shall be notified in accordance with these Conditions, and the Seller will replace the Goods (or the part in question) at no charge or, at the Seller’s discretion, reimburse the Buyer for the price of the Goods (or a proportionate portion of the price), but the Seller shall have no other liability to the Buyer.
Except in the event of death or personal injury caused by the seller’s negligence, the Seller shall not be liable to Buyer for any representation, or any implied warranty, condition or other term, or any other legal obligation, or under express terms of the Contract, for any loss or damage (whether for loss of profits or otherwise), costs, expenses or other indemnification claims (whether caused by the negligence of the Seller, its employees or agents or other type) arising from or in connection with the supply of the Goods or their use or resale by the Buyer, except as expressly provided in these Conditions.
The Seller shall not be liable to the Buyer for any delay or breach of the Seller’s obligations, if the delay or breach was due to any cause beyond the reasonable control of the Seller.
The total responsibility of the Seller may not exceed the value of the Goods listed on the invoice issued by the Seller. Upon acceptance of liability by the Seller, the Seller will have the option to refund the price of the Goods or to replace them within a reasonable time. Any substitution must be accepted by the Buyer in substitution of any other right with respect to the replaced Goods.
The warranty period will be 3 years (for products sold on or after 1 January 2022) from the sale to the end customer for new Goods, and 6 months for repairs.
